3. Types and scope of electronic services

Through the website, Energy Trend provides the following electronic services in particular:

  • access to website content – allowing users to view information about Energy Trend, its services, completed projects, expert materials and contact details,
  • contact and service enquiry forms – allowing users to submit business enquiries or requests for contact, consultation, quotations or proposals concerning a particular service,
  • file attachments – allowing users to submit, together with a form, documents needed for the initial assessment of an enquiry, such as invoices, contracts, proposals, technical documentation, floor plans, diagrams, photographs or other service-related materials,
  • electronic contact channels – in particular, links for contacting Energy Trend by email and, if implemented, via WhatsApp or a similar communication tool,
  • privacy and cookie settings – allowing users to manage their consent to optional technologies used on the website.

Energy Trend does not operate an online shop through the website, does not create user accounts and does not provide for the automatic conclusion of paid contracts for its core services.

4. Business enquiries and contracts for Energy Trend services

The forms available on the website are intended to initiate business contact with Energy Trend. Submitting a form, message or documents constitutes a request for Energy Trend to make contact, review the enquiry, prepare a quotation or proposal, or discuss the potential scope of cooperation.

Submitting a form does not, in itself, automatically result in a paid contract for an audit, analysis, measurement, implementation, brokerage service or any other Energy Trend service.

As a general rule, content published on the website is for information and marketing purposes. Unless expressly stated otherwise for a specific service, such content does not constitute a contractual offer but an invitation to make contact and begin individual discussions.

After receiving an enquiry, Energy Trend may contact the user by email or, if the user has provided a telephone number, by telephone to discuss the enquiry, obtain additional information and present a cooperation proposal.

Contact relating to a specific enquiry does not constitute the user’s consent to subsequent marketing unrelated to that enquiry. The rules governing further marketing are described in the Privacy Policy.

5. Technical requirements

To use the website properly, users need at least:

  • a device with Internet access,
  • an up-to-date web browser supporting HTML, CSS and JavaScript standards and secure HTTPS/TLS connections,
  • an active email account – if using a form that requires an email address or wishing to correspond electronically,
  • the technical functions needed to operate forms and anti-spam safeguards enabled.

When submitting attachments, users must comply with the accepted file types, maximum file sizes and any other restrictions specified for the relevant form. Energy Trend may refuse to accept a file if its format, size or content poses a risk to the website’s security or prevents the file from being read correctly.

6. Rules for using the website

Users must use the website lawfully, in accordance with accepted standards of conduct and these Terms and Conditions, and with respect for the rights of Energy Trend and third parties.

In particular, users must not:

  • submit unlawful content,
  • submit content that infringes copyright, trade secrets, personal rights or other third-party rights,
  • impersonate another person or provide data they are not authorised to disclose,
  • upload malware, scripts, files capable of disrupting the website or other content that creates an IT security risk,
  • attempt to gain unauthorised access to the website, server, forms or other Energy Trend systems,
  • send automated spam or bulk enquiries or engage in activities that may place an excessive load on the website’s infrastructure.

If users submit documents containing data or information about other people or organisations, they should be authorised to disclose it to Energy Trend and limit the information provided to what is necessary to handle the enquiry.

7. Conclusion and termination of an electronic services agreement

An agreement for the provision of a particular free electronic service is concluded for the period during which that service is used:

  • when browsing the website – from the moment the user starts accessing the relevant content until they leave the website,
  • when using a form – from the moment the user starts using the form until it is successfully submitted or the user decides not to submit it,
  • when submitting an attachment – for the time needed to transfer the file through the form,
  • when using the consent management tool – for the time spent using the settings panel and saving the selected preferences.

Users may stop using an electronic service at any time by leaving the website, discontinuing completion of a form or closing the relevant tool.

Energy Trend may suspend the provision of an electronic service to a user who uses the website unlawfully, endangers system security or seriously breaches these Terms and Conditions.

8. Specific risks associated with electronic services

Using services provided electronically involves risks typical of the Internet, including malware, phishing attempts, theft of access credentials, unauthorised access to devices or data transmissions, and exploitation of vulnerabilities in outdated software.

To reduce these risks, users should, in particular, keep their operating system and browser up to date, use security software, protect access to their email account and avoid opening suspicious files or links.

Energy Trend uses technical measures to support the security of the website, including HTTPS/TLS encryption of data in transit and tools to protect against abuse and automated spam.

9. Complaints about electronic services

Complaints concerning the operation of the website or electronic services may be submitted:

  • by email to audytor@energytrend.pl,
  • in writing to Energy Trend’s registered office address specified in section 2 of these Terms and Conditions.

To facilitate the handling of a complaint, it is helpful to provide:

  • the name of the individual or organisation submitting the complaint,
  • an email address to which a reply can be sent,
  • a description of the problem,
  • the URL of the relevant page or the name of the form concerned,
  • the approximate date and time of the problem, if known.

Complaints are reviewed without undue delay, generally within no more than 14 days of receipt. If additional information is needed to review a complaint, Energy Trend may ask the complainant to provide it.

Complaints concerning the scope, fees or performance of a paid Energy Trend service are handled in accordance with the relevant proposal, order or agreement and are not complaints about electronic services within the meaning of these Terms and Conditions.

10. Personal data, cookies and third-party tools

The rules governing the processing of website users’ personal data are described in the Privacy Policy.

Information about cookies and similar technologies, their purposes, providers and retention periods is available in the Cookie Policy and the consent management panel on the website.

The website may use third-party services, in particular infrastructure, security, analytics, advertising and communication providers. If a WhatsApp widget or another third-party feature is introduced on the website, its use may also be subject to that provider’s terms and privacy policies.

11. Website availability and liability

Energy Trend makes reasonable efforts to ensure that the website and forms operate correctly and remain continuously available but does not guarantee uninterrupted access to all functions.

Service interruptions or restrictions may result, in particular, from maintenance, updates, infrastructure failures, the operation of telecommunications or hosting providers, cybersecurity incidents or other circumstances beyond Energy Trend’s control.

Energy Trend is not liable for problems arising solely from a user’s device, software, Internet connection or system configuration, subject to mandatory provisions of applicable law.

Nothing in these Terms and Conditions excludes or limits any rights users have under mandatory provisions of law.

12. Amendments to the Terms and Conditions

Energy Trend may update these Terms and Conditions, in particular, following changes in legislation, the scope or operation of the website, the introduction of new forms or features, changes in the technologies used or a need to clarify security rules.

The current version of these Terms and Conditions is published on the website together with the date of the last update. Amendments do not affect electronic services that were properly completed before the new version took effect.

13. Final provisions

These Terms and Conditions are made available to users free of charge on the website in a form that allows them to view, save and retain a copy.

Matters not covered by these Terms and Conditions are governed by Polish law, in particular the Polish Act on the Provision of Services by Electronic Means, the Polish Electronic Communications Law, the General Data Protection Regulation (GDPR) and other applicable legislation.

These Terms and Conditions take effect on 27 August 2026.
